Terms of Service

These Terms of Service ("Terms") govern your access to and use of the fvequals financial independence planning application ("Service") operated by FVequals LLC ("fvequals," "we," "our," or "us"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account, starting a free trial, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old to use fvequals. By using the Service, you represent that you meet this requirement.

2. Description of Service

fvequals is a financial independence planning tool that allows users to input their income, investment accounts, and monthly budget to generate a personalized financial independence (FI) number and projected timeline to financial independence.

The Service uses publicly available Consumer Price Index (CPI) inflation data, aggregated across spending categories, together with user-provided inputs to produce financial projections. Projections are for educational and planning purposes only. See Section 7 for the full disclaimer.

We reserve the right to modify, suspend, or discontinue the Service or any features at any time, with or without notice.

3. Account Registration

To access the Service, you must create an account using a valid email address. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account credentials
• Notify us promptly at support@fvequals.com if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

4. Subscriptions and Payments

Subscription Plan

After your free trial period (see Section 5), continued access to the Service requires a paid subscription at the then-current rate. The current subscription price is:

Subscription prices may change at any time. We will notify you at least 30 days in advance of any price increase.

Billing and Payment Processing

All payments are processed by Polar (polar.sh). By subscribing, you authorize Polar to charge your payment method on a recurring monthly basis. Your subscription renews automatically on the same calendar date each month unless you cancel before the renewal date.

5. Free Trial

New users are eligible for a 14-day free trial upon account creation. During the trial period, you have full access to the Service. No payment is required to start a trial.

We reserve the right to limit the free trial to one per person. Creating multiple accounts to obtain additional free trials is a violation of these Terms.

6. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@fvequals.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

Refund Policy

Subscription fees are non-refundable except as required by applicable law. If you cancel mid-period, you will not receive a refund for the remaining portion of that billing period.

In exceptional circumstances (e.g., a verified billing error on our part), we may issue a refund at our sole discretion. To request a refund, contact support@fvequals.com within 14 days of the charge in question.

7. Not Financial Advice

The projections, calculations, and outputs provided by fvequals are based on user-entered data, mathematical models, historical averages, and publicly available economic data (such as CPI). These outputs:

• Are estimates only and are not guaranteed to be accurate or complete
• Do not account for all variables that affect actual financial outcomes
• Are not predictions of future investment performance or returns
• Should not be relied upon as the sole basis for any financial decision

Before making any significant financial decision, consult with a qualified, licensed financial advisor, tax professional, or other relevant expert who can evaluate your specific situation.

Past performance of investment markets is not indicative of future results. The safe withdrawal rate research referenced by the Service (including the Trinity Study) reflects historical data and does not guarantee any specific outcome for any individual.

8. User Responsibilities

You are solely responsible for the accuracy of the financial information you enter into fvequals. The quality of the Service's projections depends entirely on the accuracy of your inputs. You agree to use the Service only for lawful purposes and in accordance with these Terms.

9. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape or copy any part of the Service for commercial purposes without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to exploit the free trial offering
• Share your account credentials with others

10. Intellectual Property

The Service and its content, features, functionality, and underlying technology are owned by fvequals and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial financial planning purposes.

You retain all rights to the financial data you enter into the Service. By using the Service, you grant us a limited license to process and store your data as necessary to provide the Service as described in our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FVEQUALS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FVEQUALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING ANY FINANCIAL LOSS OR LOSS OF DATA ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless fvequals and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or any financial decisions you make based on outputs from the Service.

14. Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason — including violation of these Terms or non-payment. You may terminate your account at any time by canceling your subscription and contacting us at support@fvequals.com.

Sections 7, 10, 11, 12, 13, and 15 of these Terms survive any termination.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith informal negotiation. If not resolved within 30 days, disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive any right to participate in class action lawsuits or class-wide arbitration.

16. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date above and, where required, by emailing the address on your account. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
